MIB language in appropriation bills
The Mississippi Industries for the Blind is a state agency andbody politic and corporate. Miss. Code Ann. Section 43-3-101. It was created to establish industries, businesses, shops and workshops for the employment of the blind and other persons, to employ blind persons whose training is not otherwise provided for and to market their products, and to furnish materials, tools and books for use in rehabilitating blind persons for employment, and to do any and all other things for blind persons as it deems advisable. Sections 43-3-107. Miss. Code Ann.
Miss. Code Ann. Section 31-7-13 (m) (xxiv) exempts from advertising and bidding requirements set forth in the statute, purchases made by state agencies or governing authorities involving any item that is manufactured, processed or produced by the Mississippi Industries for the Blind. An Official Attorney General’s Opinion dated April 7, 2003 , states…. “Pursuant to Miss. Code Ann. Section 43-3-101 MIB may sell products to state agencies that are manufactured, processed and produced by it in house, and these transactions are exempt from purchase law requirements set forth in section 31-7-13 (Supp.2002)”.
The Department of Finance and Administration would urge state agencies and governing authorities to conduct a spending analysis to determine what products they are currently buying that could be purchased from the Mississippi Industries for the Blind.
